It my pleasure to offer some added information which may help in the class action suit against Bennett Environmental . (see: Valerie C. Stefani v. Bennett Environmental, Inc) A number of references to “fraudulous claims” have been made about contracts with Sevenson Environmental Services, Inc and the American Army Corps of Engineers.

A point worth investigating is that it is likely that Sevenson, and other associates, clients and /or partners, may have wisely reconsidered Bennett after being repeatedly warned by a number of groups and associations in eastern Canada who resist the importation of hazardous materials in the area and the operation of the said incinerator(thermal oxidizing unit). (See following document. )

Indeed, after over a year of the widest and most diverse activism in the history of eastern Canada, opposition to Bennett's incinerator is stronger, more active and more impatient than ever. The latest “Warning Fire” activity proves this point.

The Bay of Chaleur's fight against Bennett is known worldwide and support for the resisting coalition is still growing . As warned in the letter to the investors, federal representatives on both sides of the Bay have lost their elections and many Quebec and New Brunswick politicians are in trouble .

With a minority government, Canada can no longer afford to maintain it's corrupt ties with Bennett, and our Prime Minister will not get away with the investment of Canadian Pension Fund money in Bennett Stock, even after public knowledge of Danny Ponn's and other Bennett official's divestment of their Bennett Stock . I predict that our new federal members of the national assembly will bring up the point in parliament and that the liberal government will have to deal with yet a new scandal .

I believe that the claim made by John Bennett that opposition is minimal and winded can also be considered fraudulous. The “Warning Fire” activity, which surrounded hundreds of miles the Chaleur Bay waterfront with bonfires indicating opposition to Bennett, was a last warning after a year of steady political, legal, media and popular action . If construction continues, ACTION will be taken, with the enthusiastic, widespread and unanimous support of the population of Northern New Brunswick and Eastern Quebec.

I hope that I have convinced you , as well as Ms. Stefani and all other investors in the class action suit, that the New Brunswick Bennett plant WILL NOT operate and that all would be best advised to bail out from Bennett as soon as possible.

I feel that it is my duty to tell you that

BENNETT ENVIRONMENTAL IS A BAD IDEA !

Do you really want to invest in a company who has aroused the ire of the entire population of two Canadian provinces surrounding the Chaleur Bay ?

Never in the history of the Gaspé peninsula or of the Acadian coast has there been such a unanimous mobilisation of all communities, uniting the French, English, Micmac, Irish and Acadians .

Since June 2003, the degree of anger and actions has been steadily increasing, goaded on by the arrogance and recklessness of Bennett Environmental and the New Brunswick government.

•  Anyone could see that the study paid for by Bennett was flawed :

•  Everyone who looks across the bay can see that the wind dispersion model is wrong.

•  The company and the government blatantly lied about dioxins .

•  The combined effects with the already unacceptable pollution of the area were ignored

•  Bio-accumulation was also ignored.

•  A 46 000 signature petition (the adult population on both sides of the bay) plus 134 resolutions passed by town councils, community organisations and businesses were also ignored .

Bennett Environmental has lost it's credibility along with anyone associated with it. Just watch how thoroughly our federal MNA will be trounced from his seat during the coming elections. And see how much money will be lost due to a boycott of IRVING products .

Due to this whole situation, it is highly unlikely that the Bennett Incinerator will ever operate .

•  Toxic waste incinerators have been banned in Europe, the U.S. and even Mexico . It is only a matter of time till they will be banned in Canada also .

•  The people of the Chaleur Bay have won the hearts of a wide public due to a vast, ongoing campaign that has included the press, television, popular music and TV stars and the electronic media .

•  We also have the support of a number of international organisations such as Greenpeace, the Sierra Club, Friends of the Earth, First Nations organisations , medical associations , UNESCO and others .

•  Civil Disobedience and Non-Violent Direct Action training has already begun in both provinces, on both sides of the bay, supported by national and international organisations . Shipments and operation can and will be effectively blocked, by dedicated people who have no fear of arrest and who have the widespread support of the entire population.

•  Links have been made, communication and friendships have been established between the Chaleur Bay area and the people of Saint-Ambroise. The continuing operation of the Saint-Ambroise plant is also highly unlikely.

There is no way the people of this area will ever permit American toxic waste to be spread into our environment. The discussion is now closed. Bennett should leave. Due to arrogant manœuvres and condescending P.R. , it has gone past even important issues like cancer rates. The pride and dignity of the people of New Brunswick and Quebec has been insulted and the world will see just how stubborn maritimers can be when it comes to protecting their homes and their children's future .

If I may make a suggestion, have your investors look into bioremediation and /or closed system technologies that don't include transport of dangerous materials through other areas or across borders .
